1. Missing deadlines
Purchase & Sales Contracts are full of specific timelines including expirations, responses, repairs and closing dates. If you do not know the timelines you could be in breach of contract. This means your buyer could walk away with the earnest money when they were in default of the contract.
2.Misrepresentation
We live in a very litigious society and saying or writing something inaccurate about your home could get you in big trouble! From property lines to history of the home, if you don’t know with 100% confidence you probably shouldn’t say it.
3. Disclosures
There are 3 levels of disclosure – Initial disclosures at the time of contract, disclosures about repairs and final disclosure at closing. If you are not clear in your communication to a buyer about all disclosures you may find yourself in a lawsuit.
4. Agency & fiduciary duty
Many legal real estate battles have to with someone not being represented appropriately. An agent must explain how you, their client or customer, is being represented in the transaction. Sellers always believe their agent is looking out for their interests but if there is not a buyer’s agent involved, you could end up in a situation that does not match your expectations.
5. Fair Housing
Discrimination is a big deal and there have been big laws against it. If you or your agent, do not understand the rules protecting people groups in published marketing, your home could get tied up in a legal mess.
6. Misleading Advertising
Every seller’s goal is to sell their home quickly for the most money and with the least amount of hassle. You need to be sure your home is being advertised truthfully without gimmicks that can cause a lot of hassle.
